DADT on IN THE LIFE

In 2008, President Barack Obama secured the LGBT vote, promising full equality for the community. Two years later, many are critical of the pace of change. This month on IN THE LIFE, we ask if the man in the White House is an advocate for gay rights, and service members talk to Senator Kirsten Gillibrand (D-NY) about ‘Don’t Ask, Don’t Tell.’ The episode will feature: David Hall, a former airman, Julianne Sohn, a former Marine officer, and Dan Choi, a former Army Lieutenant.

In The Line Of Duty Or Discrimination?

The U.S. House has voted to repeal “Don’t Ask, Don’t Tell,” the policy that bans gay and lesbian people from serving in the military. The Senate is expected to take up the issue later this year and a military-wide study is underway to assess the effects of lifting the 17-year-old ban….

“Fehrenbach Discharge Would Violate Federal Law” - Palm Center

As USAF Lt. Col. Victor Fehrenbach is facing imminent discharge under DADT, the Palm Center has released a new report that shows that his discharge would be in violation of a 9th Circuit Court decision. In Witt v. Department of the Air Force, Maj. Margaret Witt challenged the policy, and the court held that the Pentagon must show that a servicemember undermined his or her unit if that individual is to be discharged under “don’t ask, don’t tell.”  The Obama administration declined to appeal, and this decision is binding on the Western states covered by the 9th Circuit - including Idaho, where Fehrenbach served.
